Abstract

People with special needs are considered one of the important groups in society,
which have not received sufficient attention and whose rights have not received the
necessary protection, whether at the international or national level. However, in
recent years, the international community’s interest in the rights of this group has
increased, as the Declaration on the Rights of the Mentally Retarded was issued
and then issued. After that, the Declaration on the Rights of Persons with
Disabilities of 1975, and after that, many international declarations and conventions
were issued. The United Nations approved the International Convention on the
Rights of Persons with Disabilities of 2006, which is the first comprehensive
agreement that includes the rights of persons with disabilities. The agreement
imposed obligations on the countries to which it joined, to take Legislative and
administrative measures are taken to protect this group. Iraq was one of the
countries that joined this agreement, as it paid attention to the rights of this group
by joining the agreement and ratifying it in 2012. To fulfill its international
obligations, it issued the Caring for People with Disabilities and Special Needs Law
No. 38 of 2013, in addition to the laws Other related.
